Allgemeine Geschäftsbedingungen (AGB)

1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen über den Online-Shop www.milimizzi.com

Kunden können sowohl Verbraucher im Sinne des § 13 BGB als auch Unternehmer sein. Bestimmte Rechte, wie das Widerrufsrecht, gelten ausschließlich für Verbraucher.

2. Vertragspartner
Der Kaufvertrag kommt zustande mit der im Impressum genannten Anbieterin:

3. Vertragsabschluss
Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine Einladung zur Bestellung.
Der Vertrag kommt zustande, wenn der Kunde durch Anklicken des Buttons „Jetzt kaufen“ eine verbindliche Bestellung abgibt und die Verkäuferin diese per E-Mail bestätigt.

4. Preise und Zahlungsbedingungen
Alle Preise sind Endpreise in Euro. Aufgrund der Kleinunternehmerregelung (§ 19 UStG) wird keine Umsatzsteuer ausgewiesen.
Zahlungsmethoden:

  • PayPal
  • Kreditkarte (über Stripe)
  • Vorkasse per Banküberweisung

Der Versand erfolgt nach vollständigem Zahlungseingang.

5. Versand und Lieferung
Der Versand erfolgt in der Regel innerhalb von 3–7 Werktagen nach Zahlungseingang mit DHL oder einem vergleichbaren Anbieter. Lieferzeiten ins Ausland können abweichen.
Die Versandkosten werden im Bestellprozess angezeigt.
Ist eine Zustellung aufgrund falscher Adressangaben oder Annahmeverweigerung nicht möglich, trägt der Käufer die Rücksendekosten, sofern er dies zu vertreten hat.

6. Eigentumsvorbehalt
Bis zur vollständigen Bezahlung bleibt die gelieferte Ware Eigentum der Verkäuferin.

7. Widerrufsrecht
Verbrauchern steht ein 14-tägiges Widerrufsrecht nach den gesetzlichen Vorschriften zu.
Details finden sich in der auf der Website gesondert abrufbaren Widerrufsbelehrung.

Vom Widerruf ausgeschlossen sind:

  • Auftragsarbeiten und personalisierte Kunstwerke
  • Digitale Inhalte, sobald diese übermittelt wurden

8. Gewährleistung und Transportschäden
Es gelten die gesetzlichen Mängelhaftungsrechte.

Bitte prüfen Sie die Lieferung umgehend nach Erhalt. Offensichtliche Transportschäden reklamieren Sie möglichst sofort beim Zusteller und informieren uns innerhalb von 48 Stunden mit Fotos.
⚠️ Hinweis: Die Versäumung einer Reklamation oder Mitteilung hat keine Auswirkungen auf Ihre gesetzlichen Rechte, erleichtert uns jedoch die Durchsetzung von Ansprüchen gegenüber dem Frachtführer oder der Transportversicherung.

9. Urheberrecht
Alle auf der Website dargestellten Werke, Texte und Abbildungen sind urheberrechtlich geschützt.
Mit dem Kauf eines Originals oder Fine Art Prints erwerben Sie ausschließlich das physische Werk.
Jegliche Vervielfältigung, Veröffentlichung oder kommerzielle Nutzung ist nur mit ausdrücklicher Zustimmung der Künstlerin gestattet.

10. Haftung
Die Verkäuferin haftet uneingeschränkt für Vorsatz und grobe Fahrlässigkeit.
Bei leichter Fahrlässigkeit wird nur für wesentliche Vertragspflichten (Kardinalpflichten) gehaftet und nur für vorhersehbare, vertragstypische Schäden.
Die Haftung für Schäden aus der Verletzung von Leben, Körper oder Gesundheit bleibt unberührt.

11. Anwendbares Recht
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.
Für Verbraucher mit gewöhnlichem Aufenthalt in der EU gelten zusätzlich die zwingenden Verbraucherschutzvorschriften ihres Wohnsitzstaates.
Gerichtsstand für Unternehmer ist Berlin.

12. Streitbeilegung
Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit:

Wir sind zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle weder verpflichtet noch bereit.

Welcome to Mili Mizzi – Art that blooms with you. Thank you for being here and for stepping into my creative world. These Terms & Conditions exist to make sure your experience is clear, fair, and enjoyable while protecting both you as the collector and me as the artist.

1. Scope
These Terms & Conditions apply to all purchases made through my online shop at www.milimizzi.com

They apply to both private collectors (consumers) and businesses. Certain rights, such as the right of withdrawal, are reserved for consumers.

2. Contracting Party

3. How the Contract is Formed
The artworks and products shown in the shop are invitations to fall in love – but they are not yet binding offers.
A purchase is confirmed when you:

  • Place an order by clicking “Buy Now,” and
  • Receive an email confirmation from me.

Only then is the contract completed.

4. Prices & Payment
All prices are shown in Euro (€). As a small independent artist, I do not charge VAT according to German tax law (§ 19 UStG).
Available payment options:

  • PayPal
  • Credit card (via Stripe)
  • Bank transfer in advance

Your artwork will be shipped once payment has been received in full.

5. Shipping & Delivery
Each piece is carefully packed and normally shipped within 3–7 business days of payment. I use DHL or a comparable service. Delivery times vary depending on your country.
Shipping costs are shown during checkout.
If delivery fails because of an incorrect address or refusal to accept the parcel, the return costs will be the buyer’s responsibility (unless you had no fault or you are exercising your right of withdrawal).

6. Ownership
Until full payment is received, the artwork remains my property.

7. Right of Withdrawal
Consumers in the EU enjoy a 14-day right of withdrawal as required by law.
Details can be found in the dedicated Return & Refund Policy.

Please note:

  • Custom commissions and personalized works cannot be returned.
  • Digital downloads cannot be returned once the file has been sent.

8. Warranty & Transport Damages
Your legal warranty rights apply.

If your package arrives visibly damaged, please:

  • Report it immediately to the delivery carrier, and
  • Contact me with photos within 48 hours.

⚠️ Important: You are not legally obliged to do this – but it helps me claim damages from the shipping company and ensures a faster solution for you.

9. Copyright
Every artwork, text, and image on this website is protected by copyright.
By purchasing an original or print, you acquire the physical piece itself.
All reproduction, publishing, or commercial use requires my prior written consent.

10. Liability
I take every care in preparing and shipping your artwork.
I am fully liable for damages caused intentionally or through gross negligence.
For simple negligence, I am liable only if essential contractual obligations are breached, and then only for foreseeable and typical damages.
Nothing in these Terms limits liability for injury to life, body, or health.

11. Governing Law
All agreements are governed by the laws of Germany, excluding the UN Sales Convention.
For EU consumers, the mandatory consumer protection laws of your country of residence also apply.
For business customers, the place of jurisdiction is Berlin.

12. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):
